CPS to consider manslaughter charges over death of Hull man

The Crown Prosecution Service are said to be considering manslaughter charges in the case of a man who was unlawfully killed after public transport staff restrained him.

Jack Barnes, 29, from Hull died in Manchester.

He shouted “I can’t breathe” after being restrained by Metrolink workers.

Mr Barnes suffered a cardiac arrest and died weeks later.

The Crown Prosecution Service (CPS) had previously ruled out manslaughter but has now ordered a review following a number of protests.

The incident was captured via body-cam footage, and four men were arrested, but no-one has ever been charged over the death of Jack Barnes.

Four Metrolink workers chased Mr Barnes for nine-minutes following a row with him at Manchester Victoria station.

One  of the four workers can be seen being held down with his left cheek on the pavement.

Mr Barnes asked for help, repeatedly shouting out: “I can’t breathe.”

Despite the footage, CPS said there was not sufficient evidence to prosecute.

Now the CPS is considering manslaughter charges. A spokesman said:

“Upon consideration of the inquest material, together with representations from the family, we have expanded our review to include all options, including manslaughter offences.

“Any decision will be made in accordance with our legal tests.”
