Grimsby homeowner fined for leaving 1.7 tonnes of rubbish in garden

A homeowner in Grimsby has been fined for leaving 1.7 tonnes of rubbish in her front garden

Laura West, who lives in Surrey but is the homeowner of the vacant property in Gilbey Road, Grimsby, has been fined for leaving 1.7 tonnes of rubbish in her garden.

The fines and court bills she has been issued with add up to £962.

She had ignored previous legal warnings to clean up the mess in the front garden which included bags of rubbish and broken furniture, and which came to a total of 1.7 tonnes of rubbish.

Further rubbish in the back garden included more bags of rubbish, cardboard, furniture, sofas, doors, etc.

On the 1st of April 2019, Ms West was issued with an informal warning letter. This was followed by a legal notice on the 5th of June, which stated that the rubbish had to be removed within 28 days. No attempt was made to clear up the mess by the homeowner, and the council subsequently arranged for the garden to be cleared. This cost £626.

It has now been cleared by North East Lincolnshire Council enforcement officers.

Ms West was then issued with a court summons for the 28th of February 2020, but she failed to attend.

She was found guilty in her absence of failing to comply with an abatement notice.

The court have now ordered the defendant to pay a fine of £600, £300 in costs, and a victim surcharge of £62.

Councillor Ron Shepherd, portfolio holder for Safer and Stronger Communities, said:

“It is not acceptable for property owners to leave waste accumulating in gardens, there is a responsibility on the property owner to ensure safe disposal.

We will pursue through the courts anyone who does not ensure safe disposal of waste when directed too.

The actions of this individual render the area unsafe, potentially subject to arson and the possibility of the introduction of vermin. This will not be tolerated by the Council.”
